versus PROMILA ..... Respondent Through: Mr. Ashok Tobria with Mr. Pradeep Kr. Pathak, Advocates.

CORAM:

HON'BLE MR. JUSTICE S. RAVINDRA BHAT HON'BLE MS. JUSTICE DEEPA SHARMA

O R D E R

% 13.07.2016 The appeal is directed against an order allowing the application under Section 24 of the Hindu Marriage Act. The impugned order has directed the appellant/husband to pay `10,000/- (Rs. Ten thousand) as ad interim maintenance. Various submissions were urged on behalf of the appellant.

After hearing counsel, the Court is of the opinion that there is no merit in the appeal since the reasons recorded by the Family Court are based upon the evidence placed before it as well as the conduct of the appellant. Learned counsel submitted, however, that the respondent/wife has since obtained employment and is concealing these facts.

In the circumstances, it is open to the appellant to seek variation of the order in the light of the materials available. It is open to the appellant to approach the Family Court with an appropriate application for modification with all relevant materials. The said application shall be decided on its merits.

The appeal is dismissed as not pressed but subject to the above liberty.
