% 14.01.2016 Learned counsel for the petitioner after some hearing accepts that the impugned order dated 4th November, 2015 interpreting paragraph 5 of the MACP guidelines is correct and, therefore, he would not press the present writ petition. He, however, submits that the pay band and the grade pay as fixed in Sashastra Seema Bal (SSB) is not on parity with his counterparts in other organisations/ministries and he would like to raise the said issue by way of a separate OA. We take the said statements on record and observe it will be open to the petitioner to raise the said issue in accordance with law. It will be also open to the respondents to challenge and question the
contention of the petitioner. The order passed in the impugned OA and the present writ petition will not be a ground not to entertain any such issue raised by the petitioner. We clarify that we have not expressed any opinion on the contention or issue to be raised by the petitioner on merits and the response of the respondents thereon. With the aforesaid observations, the present writ petition is dismissed as withdrawn. SANJIV KHANNA, J.
