O R D E R

% 07.12.2017 Before proceeding further, a submission has been made on behalf of the petitioner, that there is a settlement arrived at between Mr. Satypal who as per complaint case no. 4941/03 in the Court of learned CMM, Central District is indicated to have been arrayed therein as accused no. 2. Averments made in the present petition no. CRL.M.C 5126/2015 are to the effect that the respondent no. 2 filed a case u/s 138 of N.I. Act against the petitioner company and the petitioner company was convicted and sentenced vide order dated 04.09.2016/ 05.09.2016 passed by Ld. CJM, Panchkula, to undergo six months RI and a fine of Rs. 2,00,000/- and in default of payment of fine, to undergo SI for two months. The respondent no. 2 had filed a case u/s 138 of N.I Act against the petitioner and the respondent no. 2 in the present petition is being State.

In the circumstances, learned counsel for the petitioner seeks to withdraw the present petition with the liberty to file a fresh and appropriate petition.

Thus, the present petition stand dismissed as withdrawn with the liberty aforesaid.
