The petitioned has filed the present application seeking regular bail in case FIR No.334/2012 under Sections 397/411/482/34 IPC & under Sections 25/27/54/59 of Arms Act, PS Tilak Nagar.

Learned counsel for the petitioner submits that the petitioner is in judicial custody in this case since 19.10.2012. Learned counsel for the petitioner further submits that material witnesses have not been examined till date, which will take long time hence the petitioner may be enlarged on bail.

Learned APP for the State ensures that the material witnesses shall be examined on priority basis.

In view of the above, learned counsel for the petitioner submits that he may be permitted to withdraw the present bail application with liberty to approach the Court after the material witnesses are examined. 5.

Accordingly, the bail application is dismissed as withdrawn granting the liberty as prayed for.
