O R D E R

% 20.01.2016 Cav No.1259/2015 Since the learned counsel for the respondent has put an appearance, caveat stands discharged.

RC.REV. 649/2015 & C.M.No.29740/2015 After some arguments, learned counsel for the petitioner under instructions from his client states that he is not pressing the petition on merits. He undertakes to vacate the suit premises i.e. the second floor of property bearing No. B-225, Jhilmil Colony, Delhi (hereinafter referred to as the 'suit premises) on or before 01.09.2016. An undertaking to the said effect by way of an affidavit will be filed within a period of one week.

Learned counsel for the non-applicant/landlord points out that the rent which is at the rate of Rs.3,000/- has not been paid w.e.f. July, 2014. Arrear of rent including electricity and water charges shall also be cleared within a period of three weeks from today and this shall also be incorporated in the undertaking to be furnished by the petitioner.

Needless to state that in this intervening period, the user charges of Rs.3,000/- will be continued to be paid by the petitioner. In case of any two consecutive defaults, the compromise arrangement arrived at between the parties will stand vacated and the non-applicant/landlord will be at liberty to get the decree executed. The undertaking on affidavit shall also be filed within the aforesaid period failing which this compromise will not come into effect.

Petition disposed of.
