Learned counsel for petitioner submits that since all projects of the government in which the respondent no.3 workman could be reinstated already stand closed the impugned Award cannot be enforced. Further in the course of arguments, learned counsel for petitioner submitted that the closure of the said projects was at the stage when final arguments before the Labour Court were in the process and that aspect he had verbally intimated the Labour Court, but instead of awarding lump sum compensation, the Labour Court directed reinstatement.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition with liberty to file appropriate application before the Labour Court.
