% 27.05.2016 The petitioners seek directions for parity with the different categories of employees working in the establishment of the High Court. They rely upon the judgment in Mirza Zahid Beg & Ors. v. UOI and Ors. [W.P.(C) 484/1988, decided on 02.05.2008]; Manoj Kumar and Ors. v. High Court of Delhi [W.P.(C) 6522/2012, decided on 02.05.2013] and Sharvan Kumar Tanwar and Ors. v. High Court of Delhi and Ors. [W.P.(C) 6751/2012, decided on 02.05.2013].

This Court had adjourned the proceedings to enable the High Court to decide the issue since it was represented on previous occasions that the concerned Committee is seized of the matter. Apparently, the Committee on 05.05.2016 decided to accede to the claim and in its decision recorded in the Agenda (Item No.1) has indicated the relevant parity as between Judicial Assistants and Senior Judicial Assistants on the one hand and Personal Assistants and Senior Personal Assistants on the other. It is also indicated that the Senior Judicial Assistants/Senior Personal Assistants who complete four years of service in the Grade Pay of `4800/- would be entitled to Grade Pay of `5400/- as Non-Functional Selection Grade (in PB-3).

In view of the decision of the Committee and its recommendations, a direction is issued to the respondents to ensure that the pay fixation exercise is completed and relevant arrears are disbursed within five months from today or latest by 30.11.2016. The petitioners shall be paid in terms of the revised pay scales consequent upon the decision of the Court with effect from 01.07.2016. In the event of default, the respondents shall pay interest @ 9% effective from 01.12.2016 on the amounts payable. The writ petitions are allowed in the above terms. Order dasti.
