% 21.03.2016 Learned counsel for the petitioner submits that the disputes between the parties have been resolved. As per the settlement, the respondents have to pay the full and final amount of Rs.3,40,49,939/-, out of which the respondent No.2 has paid a sum of Rs.1,50,00,000/- to the petitioner today itself and the balance payment is to be made by the respondents on or before 28th February, 2017. Respondent No.2, who is present in Court, also agrees that till the entire payment is made, he will not press for de-attachment of the mortgaged property.

In view of the settlement, the learned counsel for the petitioner does not wish to press the present petition. The same is accordingly disposed of as not pressed.

Liberty is granted to the petitioner to revive the present petition if the payment is not made as per the settlement. Dasti. MANMOHAN SINGH, J.
