% 17.12.2015 Counsel for the respondents has produced a modified transfer order which directs the petitioner to report at Shilong in view of the peculiar condition of his son. However, counsel for the petitioner submits that he is constrained on account of two other children who are studying in Delhi and is willing to join the original place of posting at 145th Battalion, Tripura. In the light of this development, BSF was requested to see whether the petitioner's original posting could be revived. The respondents have indicated that indeed such posting is permissible and that the modified order would be withdrawn. At the same time, the petitioner requests for extended
time for reporting. In the peculiar circumstances, the respondents, while issuing the modified order posting the petitioner to 145th Battalion, Triura, shall accommodate him to the extent that his joining time is not before 01st February, 2016.
In the light of the above directions, counsel for the petitioner seeks liberty to withdraw the writ petition.
The writ petition is dismissed as withdrawn.
