% 10.12.2015 CM No. 30016/2015 (exemption) The exemption is allowed subject to all just exceptions. W.P.(C) 11399/2015 and CM No. 30015/2015 The learned counsel for the petitioner has taken instructions and fairly states that the price bid submitted by the petitioner is higher than the price bid of the L-1 bidder. Therefore, even if the petitioner was found to be technically qualified, the petitioner could not be awarded the subject tender. He further submits that the exact reasons for the technical disqualification of the petitioner have not been communicated to the petitioner. He further states that the said reasons may become an impediment for the petitioner in other tenders issued by the respondent. The learned counsel for the respondent states that the reason for disqualification shall be communicated to the petitioner within one week from today. On such communication, it will be open to the petitioner to take recourse in accordance with law. Insofar as the subject tender is concerned, the matter stands closed. The writ petition stands disposed of.
