versus DR A K GUPTA ..... Respondent Through None.

CORAM:

HON'BLE MS. JUSTICE INDERMEET KAUR

O R D E R

% 08.02.2016 The report of the Civil Judge/ARC is taken on record. The order directing the Trial Judge to dispose the petition expeditiously has been passed on 18.01.2012. It is apparent that the Trial Judge has not taken serious note of the orders passed by this Court. The explanation tendered in the report dated 15.12.2015 is wholly cursory. The concerned Trial Judge even as per her case had joined her duties in October, 2015. Matter has been prolonged on one or the other pretext and this Court has been informed that the next date fixed before the Trial Judge is 28.03.2016 which is the date after 16.11.2015 meaning thereby that the matter stood adjourned for a period of four months. This is definitely not the import of the orders passed by this Court on 18.01.2012. The Trial Judge will expeditiously dispose of the petition within an outer limit of two months from 28.03.2016. The petitioner is at liberty to move the Trial

Judge for preponement of date of hearing; the Trial Judge, if necessary shall take up the matter on a day to day hearing as the orders passed by this Court are definitely not paper orders and the Trial Court should heed to the same. Compliance report shall be placed before the Registry within 10 days from today. Petition disposed of.
