Pursuant to the order dated 31.03.2016, the respondents had offered an accommodation to the petitioner at Janakpuri. We are informed that the petitioner was not in a position to shift to the said accommodation right away for the reason that his daughter is sitting for her class 12th examinations.

Counsel for the respondents states on instructions that in view of the petitioner expressing his inability to shift right away, the accommodation offered to him had to be circulated and as and when further accommodations are identified and offered to the officers, the petitioner shall also be at liberty to apply for an allotment, which shall then be considered as per the applicable rules.

At this stage, Ms. Jyoti Singh, learned Senior Advocate appearing for the petitioner submits that the petitioner had given his acceptance in respect of premises No.C-2/131, Janakpuri, on certain conditions as set out in his Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.

letter dated 05.04.2016. She explains that the petitioner has recently lost his wife and has two young daughters to support. The younger daughter is studying in class 12th in the Army Public School, Dhaula Kuan and if he shifts to Janakpuri, then the school bus of Army Public School may not be available to ferry her to school and it was for this reasons that he has requested the respondents to consider his case sympathetically. 4.

Counsel for the respondents assures the court that the petitioner's representation shall be duly considered and decided under written intimation to him, within two weeks from today.

The petition is disposed of alongwith the pending applications. No orders as to costs.
