% 12.01.2016 During the course of hearing of the present petition, it is observed that the purpose of filing the present petition is to transfer the criminal complaint from one court of the Magistrate to other court of the Magistrate in other session's division, in view of Section 142A of the Negotiable Instruments Act.
At this stage, learned senior counsel appearing on behalf of the
petitioner, on instructions, submits that the present petition may be disposed of with the liberty to the petitioner to move an application under Section 407 of Cr. PC.
In view of the aforesaid stand taken by the learned senior counsel for the petitioner, the present petition is dismissed as withdrawn with liberty as prayed for.
It is made clear that passing of the any order by the learned Metropolitan Magistrate or the Revisional Court or the filing of the present petition shall not come in the way while considering the application under Section 407 of Cr.
