% 08.01.2016 The present application has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in FIR No.403/2015, under Sections 498-A/406/313/34 IPC, Police Station Man Sarovar Park. Notice of the application was given to the State and State was directed to file the status report.
Today additional status report has been filed by the State. As per the additional status report, the complainant has received a sum of Rs.51,000/- in the form of cash from the respondent which was stated to be given by the parents of the complainant for purchasing a motorcycle.
The petitioner also produced the list of
articles which are 22 in number.
In the facts and circumstances of the case, this Court is of the considered opinion that the accused/petitioner is entitled for the grant of anticipatory bail. It is hereby directed that in the event of arrest of the accused/petitioner, he shall be released on bail on furnishing the personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of the arresting officer. However, the petitioner is directed to join the investigation as and when required. He shall not leave the country without the prior permission of the Court concerned. He is also directed not to tamper with the evidence and influence the prosecution witnesses.
The application is disposed of accordingly.
