Counsel for the appellant has handed over to the counsel for the respondent two pay orders in the sum of Rs.3,50,000/- each bearing Nos.044375 and 044376 dated 24.10.2017 drawn on HDFC Bank, Hoshiarpur, Punjab.

These amounts are paid to the respondent by the appellant in terms of the settlement agreement dated 22.8.2017 entered into between the parties before the Delhi High Court Mediation & Conciliation Centre. This settlement agreement dated 22.8.2017 satisfies the requirements of Order 23 Rule 3 of Code of Civil Procedure, 1908 (CPC). 3.

Accordingly, the settlement agreement dated 22.8.2017 is accepted

and this appeal will stand disposed of in terms of the settlement with the further direction that the title deed which has been deposited by the appellant in this Court be returned to the appellant and respondent will now withdraw the execution petition which it has filed in the Executing Court. 4.

The present appeal is accordingly disposed of in terms of the aforesaid observations.
