% 11.01.2016 The petitioner has filed the present petition inter alia assailing orders dated 17.01.1996, 25.07.2000 and 14.10.2004 passed by the respondent No.3.
Mr.Sunil Mittal, learned counsel for the petitioner submits that the petitioner filed a suit for declaration of Bhumidhari rights under Section 73, 74 and 75 of Delhi Land Reforms Act, 1954 before SDM/Revenue Assistant, Kingsway Camp, Delhi, bearing Suit No.600/RA/87 in the year 1986. He also submits that the petitioner had filed W.P.(C) No.1399/2005. Vide order dated 21.08.2012, the said petition was disposed of with direction to respondent No.3 to decide the said suit within a period of one year.
Learned counsel for the petitioner further submits that the said suit filed by the petitioner is still pending. Mr.Naushad Ahmed Khan, Additional Standing Counsel appearing on behalf of respondent Nos.3 to 7 and 9, on instructions, submits that the suit bearing No.600/RA/87 filed by the petitioner shall be decided within a period of six months. Mr.Sunil Mittal, learned counsel for the petitioner is satisfied with the aforesaid and submits that the petition may be disposed of. In view of the above, petition as well as application are disposed with the directions to respondent No.3/Sub Divisional Magistrate/Revenue Assistant, North West District, Delhi to decide the suit bearing No.600/RA/87 expeditiously and preferably within a period of six months from the next date of hearing fixed by respondent No.3. It is made clear that the petitioner's suit would be decided on its merits without being influenced by the impugned orders.
