Crl. M C No. 5048/2015 (1) Present petition under Section 482 Cr.P.C. has been preferred by the petitioner for quashing of FIR No.144/12 under Sections 509/506/323 IPC registered at Police Station Tilak Marg, New Delhi. It is stated that the matter has been settled with the complainant/respondent No.2 amicably.

(2) Respondent No.2-complainant is present before the Court with her counsel. The Investigating Officer present in the court has identified her. I have enquired from the complainant whether the matter has been settled with the petitioner amicably without fear and Crl. M C 5048/2015

pressure. She has informed that the matter has been settled without any fear or pressure and she has no objection to the quashing of the FIR. It is further informed that pursuant to the settlement arrived at between the parties, the payment agreed to be paid has been received by the complainant.

(3) The petition is supported by the affidavits of the parties. (4) Since the petitioner has voluntarily settled the dispute with the complainant, no useful purpose will be served to continue with the proceedings. In the interest of justice and to put an end to the litigation, FIR No.144/12 under Sections 509/506/323 IPC registered at Police Station Tilak Marg, New Delhi and all the proceedings emanating therefrom are quashed. It is informed that the petitioner has deposited an FDR of Rs. 2,50,000/- before the Trial Court at the time of grant of conditional bail. Prayer has been made by the petitioner's counsel to release the said amount to the petitioner, to which the complainant has no objection. In view of the aforesaid, let the amount of Rs.

2,50,000/- deposited by way of FDR along with interest accrued over it (if any) be released to the petitioner. (5) The petitioner is, however, burdened with cost of `20,000/- to be deposited with Prime Minister National Relief Fund within two weeks. The Registry shall ensure the compliance of the order. (6) The petition and all pending application (s) stand disposed of accordingly.
