O R D E R

% 25.07.2016 Learned counsel for the petitioner fairly states that in pursuance to the order dated 15th May, 2015 passed in W.P.(C) 673/2012 petitioners have been reinstated in the service and arrears of pay and allowances have been paid. She, however, states that the arrears and allowances have been calculated at Grade Pay 1300, whereas the petitioners are entitled to Grade Pay 1800. She further states that similarly situated employees are being paid Grade Pay 1800.

However, in the opinion of this Court, the Grade Pay issue cannot be decided in contempt proceedings. Consequently, petitioner is given liberty to first file a representation with the respondents and in the event the

petitioners are aggrieved by the decision of the respondents, they are given liberty to file appropriate proceedings in accordance with law. It is clarified that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the parties are left open. With the aforesaid observations and liberty, present contempt petition stands disposed of.
