O R D E R
% 02.12.2016 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.354/2008, under Sections 323/341/506/308/34 IPC, registered at Police Station Gokal Puri, Delhi and all the proceedings emanating therefrom. Learned counsel for the petitioner submits that the petitioner and the complainants/respondent Nos.2 & 3 are the neighbourers and due to misunderstanding, the complainants have registered FIR No.354/2008, under Sections 323/341/506/308/34 IPC, PS Gokal Puri, Delhi. After the registration of the aforesaid FIR, the near relatives and close friends intervened and subsequently, the parties have amicably settled all their disputes and differences vide settlement deed dated 18-12-2014. Learned counsel for the petitioner further submits that the disputes and misunderstandings between the parties have already been resolved and nothing remains to be adjudicated upon further. He further submits that the FIR in question is coming as a hurdle in the way of the present petitioner.
He further submits that the petitioner and the complainants/respondent Nos.2 & 3 want to lead their independent and peaceful life in near future and prays that the FIR in question and all proceedings arising therefrom may be quashed.
The victims namely Sh. Samay Pal and Sh. Suresh are present in the Court today and have been identified by the Investigating Officer, ASI Puran Singh, PS Gokal Puri, Delhi. Both the victims also admit that the matter has been amicably settled with the petitioner and they have no claim or grievance left against the petitioner. They further submit that the aforesaid settlement is volunteered, without any force, pressure or coercion and they have no objection, if the FIR in question is quashed. Keeping in view the facts and circumstances of the case and the fact that the matter has been amicably settled between the parties, who are neighbourer, and it is in their interest to lead their independent and peaceful life in future, the FIR No. 354/2008, under Sections 323/341/506/308/34 IPC, PS Gokal Puri, Delhi and all proceedings arising out of the same are hereby quashed.
The present petition is disposed of accordingly. All pending application(s), if any, also stand disposed of. Copy of this order be given Dasti, as prayed. I.S.MEHTA, J DECEMBER 02, 2016/manis
