% 13.01.2016 In the morning, we had asked the learned counsel for the petitioner to obtain instructions, whether any one was promoted on regular basis between the period 2008 to 2011. Learned counsel for the petitioner has stated that as per information available, no one was promoted during the period 2008 to 2011. Learned counsel for the petitioner states that in these circumstances, he would not press the petition, however, in case anything adverse affecting the petitioner's seniority comes to his knowledge, he would move an application explaining the said

position and ask for revival of the present writ petition. Taking the statement on record, the writ petition is dismissed as infructous with liberty as prayed for. SANJIV KHANNA, J.
