% 14.07.2017 This writ petition was filed for reopening of FIR No.821/2014. The aforesaid FIR was quashed by this Court on mutual request made by the parties because of family settlement dated 23.12.2014. The petitioner has raised allegation that she was duped into accepting such family settlement and the contents of the settlement were heavily loaded against her. That apart, the ultimate reason for preferring the present writ petition was the ouster of the petitioner from the family property. Notice was issued in the aforesaid petition pursuant to which the respondent No.2 has appeared.

Mr. R.S. Kundu, learned ASC, on instructions, submits that a fresh FIR vide FIR No.211/2017 under Sections 498A, 406 and 34 of the IPC has been lodged against respondent No.2 and others on the complaint of the petitioner.

The aforesaid case is being investigated by the police. Mr.

Kundu has also informed this Court that pursuant to the lodging of the FIR, respondent no.2 was arrested also but was later granted bail. Under such circumstances, this writ petition is being disposed of with a direction to the investigating officer of FIR No.211/2017 to look into the entire allegation including the charges levelled by the petitioner against respondent No.2 for the offence under Section 313 of the IPC. It is expected that the investigation of FIR No.211/2017 shall be conducted in a fair and impartial manner and the case shall be taken to a logical conclusion as early as possible.

With these observations, the present writ petition is disposed of. Dasti.
