% 25.01.2016 In the present case, the petitioners sought anticipatory bail in FIR No.586/2015 under Sections 308/323/341/34IPC. It has been submitted by counsel for the petitioners that he has moved the petition of anticipatory bail, which was dismissed by the court of Sh.T.R. Nawal, Ld. ADJ, KKD Courts.

I have heard the counsel for the petitioners as well as Ld. APP for the State. It reveals that the bail application of the petitioners were declined on 05.12.2015 whereas the APP submitted that three accused, namely, Kanwar Pal, Amit and Vikas (now petitioner herein) were granted regular bail and in the facts & circumstances of this case, the concession of the anticipatory bail may not be granted to the remaining petitioners, i.e. Sunil and Rampal. Apart from, perusal of the file reveals that after rejection of the bail by the Court of Sessions Judge, the matter come up for hearing on 14.12.2015. Meanwhile, the

I.O. obtained the NBW against the petitioners, namely, Sunil and Rampal from the court of Ms.Mayuri Singh, Ld. MM, Karkardooma Court.

In the facts & circumstances of this case, this Court is of the opinion that no ground for grant of anticipatory bail, has been made out. However, petitioner is at liberty to approach the court issuing the NBW to cancel the NBW.

The petition stands disposed of accordingly.
