Crl.M.C. No. 39/2016 By this petition filed under Article 227 read with under Section 482 of Code of Criminal Procedure, 1973, the petitioner seeks directions to the Trial Court to expedite the trial of SC No.21/2010, FIR No. 04/2010 under Section 302/34 of Indian Penal Code, registered at Police Station Nihal Vihar, Delhi. Counsel for the petitioner contended that the FIR in this case was registered in the year 2010 and since then the matter is pending
trial. She also contended that the petitioner No.1 is in jail since 3rd March 2010 and petitioner No.2 is in custody since 23rd March 2011 and the trial of the case is extremely slow and tardy. Mr. Ashish Dutta, Additional Public Prosecutor appears on behalf of the State and accepts notice of the petition . I have heard the submissions of Counsel for the petitioner and also gone through the record of the case and perusal of the order sheet shows that the last date of hearing fixed in the case was 20th November 2015 when the Presiding Officer was on leave and the matter was adjourned to 12th January 2016.
Considering the fact that the FIR relates to the year 2010 and in view of the facts and circumstances of this case, the present petition is disposed of with direction to the concerned court to expedite the hearing of the case and complete the prosecution evidence within a period of four months from the date fixed before the concerned court. With aforesaid directions, the present petition stands disposed of.
