The Writ Petition under Article 226 of the Constitution of India read with Section 482 of the CrPC has been filed on behalf of the petitioners seeking quashing of FIR No.104/2023 dated 10.02.2023, under Sections 498-A, 406/34 of the Indian Penal Code, registered at Police Station Govindpuri, District South, Delhi.

Learned counsel on behalf of the petitioners, submits that the parties have amicably settled their disputes in the Delhi High Court Mediation and Conciliation Centre, vide Settlement dated 01.05.2024. 3.

Learned counsel for the respondents, has an objection to quashing of the FIR, on two grounds. Firstly, this is a Petition, where quashing was sought on merits and secondly, a case of Domestic Violence Act, has been filed by the mother of the petitioner No. 1, is still pending in the Court of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Bharatpur, which has till date not been withdrawn. According to the learned counsel for the petitioner, the Petition of Domestic Violence Act in the Court of Bharatpur, has been withdrawn.

Learned counsel for the respondent No. 2 insists that the Petition is still pending in the Court of Bharatpur.

Learned counsel for the petitioner, seeks permission to withdraw this Petition with liberty to file afresh, in terms of the settlement arrived at between the parties. Learned counsel further submits that in case, the Case of Domestic Violence Act in the Court of Bharatpur, is not withdrawn, it will be done within seven days.

In view of the submissions made, the Petition is permitted to be withdrawn with liberty as prayed for.

The Petition is disposed of accordingly.
