On 17.10.2016, the learned counsel for the respondents sought time to take instructions as to whether the respondents would be willing to appoint the Arbitrator in terms of the Contract in question. 2.

The learned counsel for the respondent states that he has been informed that the respondents are willing to appoint an Arbitrator from the Railways. Admittedly, an Arbitrator who is connected with the respondent organisation cannot be appointed as an Arbitrator for adjudicating the disputes between the parties.

At this stage, learned counsels for the parties agreed that they have no objection if an independent Arbitrator is appointed under the Rules of the Delhi International Arbitration Centre (DIAC). 4.

Accordingly, it is directed that an Arbitrator be appointed under the Rules of the Delhi International Arbitration Centre (DIAC).

The representatives of the parties shall appear before the Co-ordinator, DIAC on ARB.P. 116/2016

17.11.2016 at 11:00 AM. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules.

The petition is disposed of.
