% 29.09.2016 Learned counsel appearing for the respondent has handed over a copy of the letter dated 29.08.2016 which indicates that the respondent has nominated Shri R.C. Kathia, Deputy Legal Adviser presently posted in Ministry of Law and Justice, as an Arbitrator. The petitioner had already appointed Justice Mukul Mudgal, as an Arbitrator. Thus in terms of the arbitration clause both the Arbitrators are now required to concur with appointment of the presiding arbitrator. In the aforesaid circumstances, the present petition does not survive and is disposed of.

It is expected that the arbitrators shall concur with appointment of the presiding officer as expeditiously as possible and preferably within a period

of four weeks from today.
