At the outset, the respondent who appears in person, states that he shall superannuate in the end of August, 2018. He submits that in view of his imminent superannuation, nothing further would survive in the present petition wherein the petitioners have assailed the judgment dated 09.10.2015, passed by the Tribunal quashing and setting aside the respondent‟s transfer order dated 17.12.2014, and has directed that he should be given some other posting, preferably in an office located in Delhi.

Learned counsel for the petitioners submits that he has been requested by the department to seek an adjournment on the ground that Mr.R.N. Singh, Advocate who had filed the present petition, has W.P.(C) 11628/2015 Page No.1 of 2
since been appointed as a Member of the Central Administrative Tribunal, Mumbai Bench.

In view of the fact that the appointment of the learned counsel for the petitioner had taken place in the first week of July, 2018, the petitioners were expected to have taken immediate steps to appoint another Central Government counsel in his place. 4.
In any case, in our view, nothing further survives in the present petition once the respondent shall superannuate in the end of August, 2018.
