% 18.01.2016 CM Appl. 1259/2016 Exemption allowed, subject to just exceptions. W.P.(C) 308/2016 & CM Appl. 1260/2016 The present writ petition has been filed seeking a direction to respondent no. 1 to expedite the proceeding in the second appeal filed by the petitioner.
Learned counsel for the petitioner states that the petitioner filed an application under the Right to Information Act on 9th April, 2013 for supply of information regarding Income Tax Returns of MLA and Minister Captain Ajay Singh Yadav and his family members in the view of public interest i.e. Anti - Corruption. He further states that though the Central Information Commissioner clubbed the second
appeal of the petitioner with other appeals pending before a larger bench relating to the disclosure of IT Returns of MPs / MLAs on the ground of larger public interest, yet no notice regarding hearing of his case has been issued till date.
This Court takes judicial notice of the fact that there is a huge pendency of matters before the Information Commissioner. This Court does not deem it appropriate to give a direction to expedite the hearing especially when the matter is clubbed with a number of other matters, where common questions of law are involved. Accordingly, the present writ petition and application are dismissed.
