O R D E R

% 02.03.2016 I.A. No. 2935/2016 This application has jointly been moved by the parties under Order XIII Rules 1 & 3 CPC to record their settlement. Learned counsel for the plaintiff, at the outset, states that in view of the settlement arrived at between the plaintiff and defendants No.1, 2 & 4, the plaintiff withdraws the suit in respect of the other defendants. The application is signed by the parties, their respective counsel and is also supported by the affidavit of Mr. Nishank Gupta (plaintiff), Mr.Sandeeip (defendant No.2 and Director of the defendant No.1) and Mr.Manish Chhabra (defendant No.4).

In terms of the settlement, the plaintiff has already received Rs.40

Lakhs and a further amount of Rs.60 Lakhs has been tendered today by way of pay orders, which has been accepted by the plaintiff. The plaintiff has delivered the original share certificates in terms of the settlement, which has been handed over to learned counsel for the defendants. The terms of settlement appear to be fair, just and reasonable and there is no impediment in accepting the same. The suit is, accordingly, disposed of in terms of the settlement, which shall continue to bind the parties.
