In this Regular Second Appeal, notice was issued on 21.12.2015 and the judgment of the first appellate court was stayed subject to the appellant depositing the decretal amount. For the next date i.e 24.2.2016 since process fee was not filed, hence notices could not be issued. By the order dated 28.4.2016, notices were issued for today but once again since process fee was not filed, notices have not been issued. No one appeared for the appellant on the last date of hearing i.e 28.4.2016 and no one appears for the appellant even today.

This appeal is therefore dismissed in default and for non prosecution.
