BAIL APPLN. 2735/2015 The petitioners and the complainant are own brothers. All of them reside in the same residential complex. The petitioners have been made accused in FIR No.1461/2015 instituted for the offence under Sections 452/308/34 of the IPC. It has been alleged against the petitioners that they entered the house of the complainant and inflicted injuries upon him. There is a dispute between the brothers with regard to the allocation of shares in the house and because of such enmity, the petitioners have been falsely implicated by the informant. It is further
submitted that the injuries received by the informant is simple in nature.
The petitioners are in custody since 02.11.2015. Considering the relationship of the petitioners with the informant, nature of accusation and the period of custody, this Court is inclined to release petitioners on bail.
The petitioners are directed to be released on bail on their furnishing a bond in the sum of Rs.10,000/- with two sureties of like amount to the satisfaction of the Trial Court. Application is allowed.
