Instant petition arises out of the matrimonial dispute between petitioner no. 1(wife) and respondent (husband) seeking enhancement of the maintenance awarded to wife and the minor child/petitioner no. 2. Husband appears in person through video conference. 2.

This petition was filed almost 10 years ago sometime in 2015, on a query put to the learned counsel for the petitioners, if any steps have been taken before the Family Court to seek enhancement of the maintenance, given the lapse of time over which the respondent's income would have undergone a change, he submits that owing to the pendency of the present petition, no such steps were taken. 3.

In the premise, the instant petition is disposed of with liberty to the petitioner to file an appropriate application before the competent Court for enhancement of maintenance, depending upon the change of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. circumstances and increase, if any, of the respondent's income. 4.

In the parting, I may hasten to add there that merely because this Court has disposed of the petition though with liberty, same shall not be construed, in any manner by the learned Family Court as hindrance to entertain such petition and/ or decide the same on merits in accordance with law.

Meanwhile, the respondent is also bound down to comply with the impugned order herein and continue to pay until any fresh orders are passed by the learned Family Court.
