O R D E R

Learned counsel for the parties jointly state that the parties have arrived at a settlement, reduced in writing by virtue of a Memorandum of Understanding dated 24.05.2017 (copy whereof was

handed over on 27.05.2017 and taken on record). They undertake to bind themselves to all the terms and conditions of the settlement recorded in the MoU. Counsel for the appellant in MAT.APP.(F.C.) 127/2015 states that he has already paid a sum of Rs. 25 lakh to the respondent in terms of clause 6(C) of the MoU and his client undertakes to pay the balance amounts to the respondent at different stages as agreed upon and recorded in the MoU. 2.

Both the parties who are present in Court, confirm having arrived at the aforesaid settlement of their own free will and volition and without any undue influence or coercion. They undertake to abide by the terms recorded in the MoU.

In view of the parties having arrived at full and final settlement in respect of their claims and counter-claims against each other, there appears no legal impediment in taking the MoU on record. Copy of the MoU dated 20.05.2017 is taken on record. The parties shall remain bound by the settlement recorded therein. 4.

Both the appeals are disposed of in terms of the settlement arrived at between the parties while leaving them to bear them with costs.
