% 22.01.2016 The present writ petition has been filed seeking a direction to the respondents to carry out demarcation of Waqf property situated in Khasra No.546/371/249 and 258, Village Sheik Sarai (admeasuring 37 bighas and 19 biswas) within two weeks.
Petitioner further seeks a direction to the respondents to construct the boundary wall of the Waqf property after demarcation has been carried out.
Learned counsel for the petitioner states that in the absence of demarcation, the aforesaid property is being encroached upon. He further states that despite several requests for demarcation, yet the respondents have not taken any action till date.
In FAO(OS) No.501/2013, the Division Bench of this Court vide order dated 18th July, 2014 has held that proceedings concerning demarcation in Delhi are governed by the Delhi Land Revenue Act, 1954 and the Delhi Land Revenue Rules, 1962.
Consequently, the present writ petition is disposed of with liberty to the petitioner to file an appropriate proceeding for demarcation of the land.
With the aforesaid liberty, the present writ petition is disposed of.
