By way of this petition, petitioner is seeking quashing of FIR No. 338/2015, under Section 406/498A/34 IPC, registered at PS Rajinder Nagar. 2.

Learned counsel for the complainant has placed on record copy of the order dated 23.04.2016, passed by Learned MM, Mahila Court-01, Central, Delhi in case FIR No. 338/15, PS Rajinder Nagar, whereby the accused (petitioner herein) has been summoned as an accused person who is placed in column No. 12.

Learned counsel for the petitioner submits that the petitioner intends to avail the remedy impugning the summoning order and since this petition has become infructuous he seeks permission to withdraw the present writ petition.

According the writ petition is dismissed as withdrawn, granting the liberty as prayed for.
