The appeal impugns a judgment and money decree dated 16th November, 2015 of the Court of Additional District Judge-4, North West, Rohini Courts, Delhi consequent to failure of appellant to enter appearance in the summary suit being CS No.767/2014 filed by respondent. 2.

Notice of the appeal was issued and subject to the appellant depositing the decretal amount execution was stayed. 3.

Neither has any amount been deposited nor has the appellant taken any steps for service of the respondent.

Mr. Amar Nath Jha, Advocate associate of Mr. M. Hassibuddin Sak, Advocate for the appellant states that he has instructions to withdraw the appeal.

The appeal is dismissed as withdrawn.

It is clarified that the stay of execution earlier ordered stands vacated. No costs.
