% 08.01.2016 The present is a petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 praying as follows:- "a) Direct the respondents to send and consider the name of the petitioner in the Sentence Reviewing Board at the earliest."
Issue notice.
Mr. R.S. Kundu, learned Additional Standing Counsel (Criminal) accepts notice on behalf of the official respondent and states that in the event the petitioner applies to the competent authority seeking pre-mature release, the Sentence Reviewing Board shall forward the said representation to the competent authority within eight weeks thereafter. Ordered accordingly.
It is made clear that in the event the petitioner makes a representation as afore-stated for pre-mature release within a period of one week from today, the Sentence Reviewing Board is directed to forward the same for consideration to
the competent authority within eight weeks thereafter. With the above said directions, the writ petition is allowed and disposed of accordingly.
