The petitioner has filed the present bail application under Section 438 CrPC seeking anticipatory bail in case FIR no.571/2014 under Section 365/506 IPC, PS Narela, Delhi.

The petitioner before this Court is the husband of the complainant. It is informed by learned APP for the State that the petitioner has already joined the investigation but the weapon of offence is yet to be recovered in this case.

In the FIR, the complainant - wife of the petitioner has stated that on 25.04.2014 when she came out of the school, she found her husband standing outside the school. The petitioner chased her and forcibly made her to sit in his car bearing No.HR-10Q-8189 and took her towards Asoda. On BAIL APPLN. 2737/2015

the way, her mouth was tied and her neck was pressed by the petitioner with his hand.

In view of the allegations made in the FIR, there is no question of recovery of weapon of offence. In the FIR, it is also mentioned that some dowry case has already been registered against the petitioner/husband. 6.

Considering the fact and circumstances of the case and that the petitioner had already joined the investigation, it is directed that in the event of arrest, the petitioner be released on bail on his furnishing personal bond in the sum of `50,000/- with one surety of the like amount to the satisfaction of IO/SHO concerned. However, the petitioner is directed to join the investigation as and when required by the IO/SHO concerned. It is also directed that the petitioner shall not try to contact the complainant or witnesses.

As prayed, copy of the order be given dasti to learned counsel for the parties.
