At the outset, it has been enquired from learned counsel for the petitioner as to how the present petition would be maintainable when he has already approached the Armed Forces Tribunal (AFT) raising the same grievance, as raised in the present petition. Pertinently, vide order dated 31st July, 2013, the learned AFT has dismissed O.A. No.241/2013 on the ground that it was highly belated.

At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to assail the W.P.(C) 657/2016 age 1 of 2
order dated 31st July, 2013 passed by the AFT before the Supreme Court, as per law.

Leave, as prayed for, is granted.
