The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.1016/2015 registered under Sections 376/313 IPC at PS Vasant Vihar. Status report is on record.
2.
I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 17.11.2015. Upon completion of investigation, charge-sheet has been filed. Status report reveals that the petitioner and the prosecutrix were acquainted with each other since long. Physical relations had taken place between them on various occasions albeit on the alleged promise to marry. When the marriage between the petitioner and the prosecutrix did not happen as desired, the FIR was lodged. Apparently, there is considerable delay in lodging the FIR.
