% 07.01.2016 The relief claimed in this petition is to direct the learned Metropolitan Magistrate to dispose of application dated 28th October 2015 in CC No.122/13 titled "Smt. Saloni Bathla vs. Shri Sanjuj Bathla and Anr" which was heard on 9th November 2015. Counsel for the petitioner has submitted that now the case is fixed for 22nd January 2016 for the clarification/order and the petitioner has learnt that due to illness or the health reasons the

learned Metropolitan Magistrate, the application may not be disposed of on that date. He further submitted that the delay in passing the order is causing harm and shall be prejudice to the interests of the petitioner.

Counsel for the petitioner submits that the present petition may be disposed of by giving liberty to the petitioner to approach the CMM for transfer of the application, in case the application is not decided on the next date, i.e., 22.01.2016.

In the facts and circumstances of the case, the present petition is disposed of with observation that in case the application is not decided on 22nd January 2016, the petitioner shall have liberty to approach the CMM for transfer of his application. With aforesaid direction, the present petition stands disposed of.
