No payment has been made by the petitioner in compliance of the order dated 03.02.2016 to the complainant. 2.

Learned counsel for the petitioner seeks permission to withdraw the present bail application.

Vide order dated 03.02.2016, interim protection was granted to the petitioner on his assurance to pay `50 lacs within two months to the complainant without prejudice and subject to outcome of the case. The said order has not been complied. Apparently, the petitioner BAIL APPLN. 2755/2015

enjoyed the interim protection without complying with the other condition i.e. payment of `50 lacs to the complainant. 4.

In view of the above, bail application is dismissed as withdrawn with costs `25,000/- to be paid to the complainant within two weeks by the petitioner.
