Learned counsel for the appellant states that he may be permitted to withdraw the present appeal while reserving the right of the appellant to file a First Appeal against the order dated 13.10.2015, passed by the learned ADJ, dismissing an application filed by the appellant under Order IX Rule 13 CPC, for setting aside the ex-parte judgment and decree dated 13.12.2013.
