O R D E R

% 13.03.2019 Learned counsel for the petitioners has tendered in Court a copy of an affidavit dated 12.03.2019 stated to have been filed in the Registry yesterday. A copy of the same is taken on record. It is pointed out that the respondent has passed away during the pendency of the present petition and, therefore, even though the present petition was being listed along with similar petitions which batch of petitions stands disposed of by a common order dated 14.08.2018 passed in W.P.(C) No.4148/2015 and the other connected petitions, the present writ petition was not disposed of on account of service not being affected on the respondent. Vide order dated 19.09.2018, this Court

had directed the petitioner to deposit in this Court within eight weeks the amount payable to the LRs of the deceased respondent. Mr.Singh has brought a pay order for the said amount in the name of the Registrar General. It, however, transpires that there are no claimants since the son of the deceased respondent has already expressed his lack of interest in pursuing the matter and, as per the petitioner's affidavit now tendered in Court, the respondent's wife had already re-married during his lifetime.

In these circumstances, while disposing of the present petition along with the pending applications in terms of the decision in W.P.(C) No.4148/2015 decided on 14.08.2018, it is directed that the amount in terms of the order dated 19.09.2018 need not be deposited in this Court. In case, any lawful claimant seeks to establish his claim to the dues payable to the deceased respondent, the same may be examined by the petitioner on its own merits.
