% 29.01.2016 1.
The present petition has been preferred by the petitioner praying inter alia for setting aside the order dated 3rd June, 2015 passed by the Staff Officer, RPF, Jabalpur cancelling his candidature to the post of a Constable. The Registry has raised an objection with regard to lack of territorial jurisdiction.
2.
A perusal of the petition reveals that the petitioner is a resident of District Jabalpur, Uttar Pradesh and the impugned order dated 3rd June, 2015 cancelling his candidature has been passed by the competent officer at Jabalpur.
3.
Learned counsel for the petitioner submits that the limited relief that the petitioner seeks for the present is for issuing a direction to the respondents to dispose of his appeal dated 21st W.P.(C) 624/2016
August, 2015 (Annexure P-8) submitted to the respondent No.2Director General, RPF. 4.
Learned counsel for the respondent states that he has no objection to the said request, but the petitioner may not assume that disposal of his appeal by the respondent No.2, who is based in Delhi would amount to vesting a jurisdiction on this Court, for any future litigation to which the other side is agreeable. 5.
Accordingly, the present petition is disposed of with directions issued to the respondents to consider and decide the petitioner's appeal dated 21st August, 2015 in accordance with the law within eight weeks. The decision taken shall be duly communicated to the petitioner.
If the petitioner is aggrieved by the said decision, he shall be at liberty to seek his remedies before the court of competent territorial jurisdiction.
6.
This petition and application are accordingly disposed of. HIMA KOHLI, J SUNIL GAUR, J JANUARY 29, 2016 r/vn W.P.(C) 624/2016
