% 23.08.2017 Learned counsel for the plaintiff states that he has instruction to withdraw the present suit.

Today in Court, learned counsel for the plaintiff has also handed over to learned counsel for the defendant an account payee cheque bearing No. 038991 dated 9th August, 2017 for a sum of Rs. 7,50,000/- drawn upon Bank of India, Nepean Sea Road Branch, Mumbai, Maharashtra. He assures this Court that the said cheque is good for payment. In view thereof, present suit and all pending applications are dismissed as withdrawn.

The amount deposited by the defendant is directed to be refunded to the defendant within two weeks. For this purpose, list the matter before the Joint Registrar (Original) on 8th September, 2017. MANMOHAN, J AUGUST 23, 2017 rn
