% 02.08.2016 CA No.2738/2016 & CO.PET. 25/2016 This application has been moved by the petitioner seeking withdrawal of the petition in view of a settlement concluded between the parties on 18.07.2016. Copy thereof has also been annexed to this application. Issue notice.
Counsel for the respondent enters appearance and accepts notice. He approbates the said settlement and states that he does not wish to file any reply to the same. He further states that he has no objection to the withdrawal of the petition on the terms envisaged in the settlement dated 18.07.2016, which is also titled as 'Exit Agreement'. Both counsel especially undertake to this Court on behalf of their respective clients that all obligations undertaken in the said agreement by their clients shall be duly performed in the manner envisaged therein without
exception. These undertakings are accepted by this Court and the parties shall remain bound by the settlement.
Further and as prayed, the application is allowed and the petition is disposed off on the aforesaid terms. The next date of 05.12.2016 stands cancelled.
