1. This is a joint application under Section 151 CPC filed by the parties seeking necessary directions.

2. It is stated that the parties are unable to afford the fees and expenses as required to be deposited by the Delhi International Arbitration Centre („DAC‟) and they would like the sole Arbitrator to whom the matter has been referred for substitution of the earlier Arbitrator, to fix his fees.

3. In that view of the matter, the order dated 6th April, 2016 passed by this Court is modified while directing that Mr. Justice J.P. Singh, learned sole Arbitrator to determine his own fees and terms and the arbitration will not be conducted under the aegis of the DAC.
