This petition has been filed impugning the order dated 16th July, 2015, passed in Eviction Petition No.41/2014 whereby the application of the respondent seeking leave to defend was allowed. 2.

Learned counsel for the petitioner submits that after the leave was granted by the learned ARC, the case is already at the stage of petitioner's evidence and is listed within this month.

Learned counsel for the petitioner submits that since petitioner wants to continue with the trial, he may be permitted to withdraw this petition. 4.

The petition is dismissed as withdrawn.
