O R D E R

% 20.01.2016 The present writ petition has been filed seeking a direction to respondent No.1-University to declare that the petitioner had passed M.Sc. Chemistry in 2011 with 585 marks out of 1100 or to declare the petitioner having passed M.Sc. Chemistry in 2013 with 594 marks out of 1100.

Petitioner, who appears in person, states that respondent No.1Univeristy had filed seven false and fabricated mark-sheets before the National Commission for Scheduled Castes, before whom he had initially filed a representation.

A perusal of the record reveals that the stand of the University is that, in some of the mark-sheets, inadvertently wrong marks of the petitioner were shown. At page 163 of the paper book, the University has stated that the petitioner actually obtained 34 marks out of 114 in 1st semester, 27 marks out 114 in 2nd semester, 81 marks out of 200 in 3rd semester and 64 marks out of 152 in 4th semester. Consequently,

according to the University, as the petitioner had only obtained 194 marks out of 532, which was below the passing percentage, the petitioner has been failed.

In the opinion of this Court, since disputed questions of fact arise for consideration in the present writ petition, the same is dismissed with liberty to the petitioner to file a civil suit. With the aforesaid liberty, the present writ petition along with applications stand disposed of.
